GENERAL TERMS AND CONDITIONS
Please read all terms and conditions carefully as all sections of this agreement and any relevant information on this website forms part of your contract with Niktrip, LLC. By booking with Niktrip you are acknowledging that you have read, understood, and agreed with our terms and conditions. All references in these conditions to “tour”, “booking”, mean such tour arrangements unless otherwise stated. If you are booking for persons other than yourself, upon purchase you are agreeing that you have their consent to agree to these terms and conditions on their behalf.
1) BOOKING: All bookings are confirmed after payment is made in full. Client confirming booking must be at least 21 upon booking for themselves or someone else. By booking on someone else’s behalf you are acknowledging and agreeing that they have read the terms and conditions and agreed to them, or you have read and explained the terms and conditions to them and they have agreed to them freely.
2) CANCELLATION AND REFUND POLICY:
IF CLIENT CANCELS: Cancellation of tours and accompanying services by the client for ANY reason are refunded as follow:
a) Cancellation made 90 or more days before tour start date – company retains 25% of funds paid by client
b) Cancellation made by the client 89 – 31 days before tour start date – company retains 50% of funds paid by client
c) Cancellation made by client 30 – 0 days before tour start date – company retains 100% of funds paid by client
IF NIKTRIP CANCELS: We do not anticipate the cancellation of any of our tours unless a circumstance beyond our control occurs (flood, war, riot, social unrest, strikes, hurricane, acts of terror, etc. See clause 10). If Niktrip cancels, the client will be given the two following options:
a) Client can rebook another date of the same tour. Selected tour date must be within one year of cancelation
b) Client can receive 75% refund of funds paid
All bookings are NON-TRANSFERABLE between persons. Clients DO NOT have the option of switching tour dates for dates other than those that were confirmed upon full payment UNLESS the tour was cancelled by Niktrip. Niktrip, LLC is not responsible for any tours that are missed or unused by the client, and will therefore NOT offer a refund or a substitute tour. Niktrip is not liable for expenses incurred due to cancelation on the part of the client or Niktrip (transfer, flight ticket, meal vouchers, etc.). Therefore clients will not be reimbursed. Clients are responsible for purchasing comprehensive travel insurance that includes, but is not limited to cancellation of accommodation and tour services. All cancelation must be sent to Niktrip in writing for proper processing. Clients will not be reimbursed for any expenses incurred (plane tickets, hotel, food, car rental etc.) due to cancellation by Niktrip.
3) HOTEL ACCOMMODATIONS AND ITINERARY: Niktrip reserves the right to make adjustments and amendments to all tours as we see fit in the case of unforeseen events at the tour location. Niktrip also reserves the right to substitute hotels, riads, dar etc. for those of equal standards based on availability or tour participation after confirmation of booking. In the case that accommodations have been changed, there will be no refund to the client if there is a reduction in cost. There will be no added cost, if there is an increase in cost due accommodation change.
6) TRAVEL INSURANCE: All clients must obtain travel insurance independent of Niktrip. Clients are urged to purchase insurance that covers but is not limited to, flight and tour cancellation, repatriation in the event of war, riots, and acts of nature. The insurance should also cover property loss or damage that might occur during or on route to and from the tour. Niktrip and it’s suppliers are not liable for property damage incurred within the hotel or tour vehicles. Client should also have medical coverage in the event of injury while on tour as Nikrip will not be liable for any medical expenses obtained by the client.
7) LANGUAGE: For the year of 2019 – 2022, all tours will be conducted in English.
8) TRAVEL DOCUMENTS: Clients are responsible for aquirring the necessary visa and vaccinations for the country that they are visiting. The client should also be in possession of a valid passport that is at least six months from expiration. Niktrip will not reimburse clients that do not have the proper documentation and as a result are subjected to rejection of entry into the country of tour.
9) TOUR PARTICIPATION AND CLIENT RESPONSIBILITY: When booking with Niktrip clients are agreeing to abide by the authority of the Niktrip hosts, tour guides and representatives. Clients must also agree to adhere to the laws of the visiting country. Deviating from the agreed upon itinerary can result in client dismissal from the tour without a refund or compensation for added cost due to said dismissal. By booking any Niktrip tour, the client is agreeing that any behavior on their part that is deemed violent, racist, degrading to others, or that endangers the lives of others while on the tour, will result in immediate dismissal from the tour without a refund or an offer of a substitute tour. A refund or substitute tour will not be offered if the client does not take part in all activities, or decides to utilize accommodation other than those provided by Niktrip.
10) FORCE MAJEURE: Niktrip will not be liable for any bodily injury, mental destress, property damage or loss, or added expenses due to dicontinuation of services by Niktrip because of Force Majeure. Force Majeure defined as unforeseeable events that are beyond the control of Niktrip and it’s vendors. In the event of flood, earthquakes, fire, war, acts of terroism, strike, civil unrest, government shutdown or instability, extreme weather. This also extends to bankrupcy of Niktrip and it’s vendors that result in the discontinuation of service.
11) ACCEPTANCE OF RISK: Upon booking with Niktrip client is acknowledging and agreeing that they have read the itinerary of their chosen tour and understand that adventurous tours might carry the risk of bodily harm, mental distress, and property damage or loss. By booking with Niktrip the client is agreeing to assume those risk which Niktrip will not be held liable.
12) COMPLAINTS: If there is a complaint during the tour the client should notify the host, vendor, or representative immediatly so that the dispute can be rectified right away. If the issue cannot be resoled during the tour the complaint should be submitted to Niktrip in writing within thirty days of the matter occurring.
13) APPLICABLE LAW: These terms and conditions and all contracts between Niktrip and the client are subject exclusively to Florida law and is subjected to Floridian law and jurisdiction. Any disputes or claims will be resolved exclusively in the state of Florida. NIKTRIP, LLC is registered with the State of Florida as a Seller of Travel. Registration No.ST41413.
14) AMMENDMENT: Niktrip reserves the right to make amendments to it’s terms and conditions or any contractual script between the company and client. When such changes have occurred the client will be notified within seven days of said change.
